“Uploaded Content” means photographs, selfies, images, product images, videos, text, or other content submitted to the Services.

“Generated Content” means images or other content generated by AI Vastra in response to an authorized request.

“Personal Information” or “Personal Data” means information that identifies, relates to, describes, or can reasonably be associated with an individual, as defined under applicable law.

2. Information We May Collect

Depending on how the Services are used, AI Vastra may collect or process:

Merchant Information

• Business or store name;
• Website or store URL;
• Name and contact information;
• Email address;
• Account information;
• Billing and subscription information, where applicable;
• Service configuration and settings;
• Product and catalog information;
• Technical information;
• Application logs;
• Security information; and
• Communications with our support team.

Customer Information

Depending on the functionality being used, customers may voluntarily provide:

• Photographs or selfies;
• Images of themselves;
• Product selections;
• Product images;
• Virtual Try-On images;
• Device and browser information;
• IP address and technical information;
• Information submitted through forms or communications; and
• Other information necessary to provide the requested Services.

AI Vastra does not intentionally require customers to provide information that is not reasonably necessary for the requested functionality.

3. Virtual Try-On Images

AI Vastra provides AI-powered Virtual Try-On technology that may allow a customer to upload a photograph or selfie and generate an image showing how a selected product may appear on that person.

Uploaded photographs may be processed by AI Vastra and by authorized third-party infrastructure or technology providers that assist us in delivering the Services.

Processing may include:

• Receiving uploaded images;
• Temporarily storing images;
• Processing images using artificial intelligence;
• Processing product images and related information;
• Generating Virtual Try-On results;
• Returning generated results to the requesting customer or Merchant;
• Detecting and preventing misuse or abuse; and
• Deleting or anonymizing information according to our retention practices.

4. AI-Generated Content Disclaimer

AI Vastra uses artificial intelligence and machine-learning technologies.

AI-generated results may contain inaccuracies, distortions, artifacts, unexpected modifications, or other errors.

AI Vastra does not guarantee that a Virtual Try-On image will accurately represent:

• A person’s actual appearance;
• Body proportions;
• Facial features;
• Clothing size or fit;
• Garment positioning;
• Product color;
• Product texture;
• Product pattern;
• Material;
• Shape;
• Design details; or
• The actual appearance of the physical product when worn.

Virtual Try-On results are provided primarily for visualization and informational purposes.

Customers should rely on actual product descriptions, measurements, size charts, physical product information, and applicable Merchant policies when making purchasing decisions.

AI Vastra is not responsible for purchasing or other decisions made solely on the basis of AI-generated content.

5. Customer Photographs

Customer-uploaded photographs are processed for purposes reasonably necessary to provide the requested Virtual Try-On functionality and related Services.

AI Vastra does not claim ownership of customer photographs.

However, by submitting a photograph or other content, the submitting party grants AI Vastra and its authorized service providers the limited rights necessary to:

• Receive and process the content;
• Generate the requested Virtual Try-On result;
• Store the content temporarily where technically necessary;
• Transmit the content through our infrastructure;
• Maintain and secure the Services;
• Prevent fraud, abuse, and unauthorized use;
• Troubleshoot technical problems; and
• Comply with applicable legal obligations.

We do not sell customer-uploaded photographs for advertising purposes.

6. Responsibility for Uploaded Content

The person or organization uploading content to AI Vastra is responsible for ensuring that they have all necessary rights, permissions, licenses, consents, and legal authority to upload and process that content.

This includes, where applicable:

• Customer photographs;
• Model photographs;
• Product photographs;
• Brand images;
• Logos;
• Trademarks;
• Copyrighted materials;
• Fashion designs;
• Marketing materials;
• Images obtained from third parties; and
• Other intellectual property.

AI Vastra does not independently verify ownership, licensing, consent, or authorization for every item uploaded to the Services.

You must not upload content unless you have the legal right and appropriate authorization to use that content through AI Vastra.

7. Privacy and Consent Responsibilities

Merchants are responsible for providing their customers with appropriate privacy notices and obtaining any consent, authorization, or other lawful basis required by applicable law before collecting or submitting customer information to AI Vastra.

Merchants must ensure that their use of AI Vastra complies with applicable:

• Privacy laws;
• Data-protection laws;
• Consumer-protection laws;
• Intellectual-property laws;
• Advertising laws;
• Children’s privacy requirements; and
• Other applicable regulations.

AI Vastra provides technology and infrastructure and does not provide legal advice to Merchants.

8. Use of Information

We may use information to:

• Provide and operate the Services;
• Generate Virtual Try-On results;
• Process and deliver requested functionality;
• Provide technical and customer support;
• Maintain application performance;
• Improve reliability and functionality;
• Detect and prevent fraud, abuse, and security incidents;
• Troubleshoot technical problems;
• Monitor system performance;
• Maintain security;
• Process payments and subscriptions where applicable;
• Communicate with Merchants and users;
• Comply with legal obligations;
• Respond to lawful requests;
• Enforce our agreements and policies; and
• Protect our rights, property, systems, users, and Services.

9. AI Model Training

AI Vastra does not intentionally use customer-uploaded photographs or Generated Content to train general-purpose AI models unless the applicable user or Merchant has been separately informed and the necessary authorization or legal basis has been obtained.

Where third-party AI or technology providers are used, information may be processed by those providers as necessary to provide the Services.

AI Vastra does not sell customer photographs or Generated Content for advertising purposes.

10. Third-Party Service Providers

AI Vastra may use third-party service providers to operate and support the Services.

These providers may include services for:

• Cloud hosting;
• Data storage;
• AI processing;
• Image processing;
• Content delivery;
• Security;
• Application monitoring;
• Analytics;
• Customer support;
• Communications;
• Payment processing; and
• Other infrastructure services.

Third-party providers may process information on our behalf and may operate in countries other than the country in which the information was collected.

We seek to use appropriate contractual, technical, and organizational safeguards where required by applicable law.

11. International Data Processing

AI Vastra and its service providers may process or store information in different countries.

Uploaded photographs and Generated Content may be deleted automatically after processing or after a defined period depending on the applicable Service configuration.

Information may remain temporarily in encrypted backups, disaster-recovery systems, security logs, or records that we are legally required to retain.

14. Deletion Requests

Subject to applicable law and contractual obligations, users or Merchants may request deletion of applicable Personal Data or Uploaded Content by contacting:

15. Cookies and Similar Technologies

AI Vastra may use cookies, local storage, pixels, server logs, and similar technologies to:

• Operate the Services;

• Monitor performance; and
• Improve functionality.

Where required by applicable law, appropriate consent mechanisms may be used.

Merchants are responsible for ensuring that tracking technologies used on their own websites or stores comply with applicable laws.

16. Aggregated and De-Identified Information

AI Vastra may create aggregated or de-identified information from information processed through the Services.

Where permitted by law, such information may be used for:

• Analytics;
• Performance measurement;
• Security;
• Product development;
• Service improvement;
• Troubleshooting; and
• Business planning.

We will not intentionally use properly de-identified information to identify an individual.

17. Children’s Privacy

AI Vastra is not intended to knowingly collect personal information directly from children where prohibited by applicable law.

Merchants must not intentionally use AI Vastra to collect or process children’s photographs or Personal Data unless all legally required permissions, consents, and safeguards have been obtained.

If we become aware of information collected in violation of applicable children’s privacy requirements, we may take reasonable steps to delete it.

18. Prohibited Content and Uses

AI Vastra must not be used to:

• Upload photographs without appropriate authorization;
• Infringe copyright, trademarks, patents, designs, or other intellectual-property rights;
• Violate privacy or publicity rights;
• Impersonate another person without authorization;
• Create fraudulent or deceptive content;
• Process unlawful content;
• Upload malicious software or code;
• Circumvent security measures;
• Collect unnecessary sensitive information;
• Violate applicable law;
• Violate third-party platform rules; or
• Engage in activity that could reasonably expose AI Vastra or others to legal or regulatory liability.

AI Vastra reserves the right to suspend, restrict, or terminate access to the Services where we reasonably believe that the Services are being misused or used unlawfully.

19. Intellectual Property

The AI Vastra name, trademarks, logos, website, software, APIs, plugins, applications, interfaces, documentation, designs, technology, and underlying systems are owned by or licensed to AI Vastra and are protected by applicable intellectual-property laws.

Except as expressly permitted, no right is granted to copy, reproduce, modify, reverse engineer, distribute, sell, sublicense, or commercially exploit AI Vastra’s proprietary technology.

This Privacy Policy does not transfer ownership of AI Vastra intellectual property to any Merchant or user.

20. Third-Party Intellectual Property

AI Vastra does not guarantee that content uploaded by Merchants or users is free from third-party intellectual-property claims.

The person or organization submitting content is responsible for obtaining all necessary rights, licenses, releases, permissions, and consents.

To the maximum extent permitted by applicable law, AI Vastra is not responsible for claims arising from content supplied by a Merchant, customer, user, or other third party, including claims involving:

• Copyright;
• Trademark;
• Design rights;
• Patent rights;
• Privacy rights;
• Publicity rights;
• Personality rights;
• Moral rights; or
• Other third-party rights.

21. Copyright Complaints

Where appropriate or required by applicable law, we may remove, restrict, disable, or otherwise address the disputed content.

22. Merchant Responsibilities

Merchants using AI Vastra are responsible for:

• Providing appropriate privacy notices;
• Obtaining required customer consent or authorization;
• Establishing an appropriate lawful basis for processing Personal Data;
• Obtaining necessary rights and licenses for uploaded content;
• Ensuring that customer and model photographs may legally be processed;
• Ensuring that product images and brand materials may legally be processed;
• Complying with applicable privacy and data-protection laws;
• Complying with intellectual-property laws;
• Complying with consumer-protection and advertising laws;
• Responding to applicable customer privacy requests;
• Configuring the Services appropriately; and
• Using AI Vastra only for lawful purposes.

23. No Guarantee of AI Accuracy

To the maximum extent permitted by applicable law, AI Vastra provides AI-generated content and Virtual Try-On functionality on an “as is” and “as available” basis.

AI Vastra does not guarantee that:

• Generated images will be accurate;
• Generated images will be complete;
• Generated images will match the physical product;
• Virtual Try-On results will accurately show product fit;
• Product colors will be reproduced accurately;
• Product details will always be preserved;
• Facial or body features will remain unchanged;
• The Services will always be available;
• The Services will be uninterrupted;
• The Services will be error-free; or
• Generated Content will be suitable for a particular purpose.

AI-generated results should not be treated as a guarantee of physical product appearance, size, fit, quality, or performance.

24. Limitation of Liability

To the maximum extent permitted by applicable law, AI Vastra and its affiliates, officers, employees, contractors, service providers, licensors, and technology partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:

• Use or inability to use the Services;
• AI-generated content;
• Virtual Try-On results;
• Inaccurate or unexpected AI results;
• Customer purchasing decisions;
• Product fit or sizing;
• Merchant- or customer-submitted content;
• Copyright or intellectual-property claims arising from user-supplied content;
• Privacy or publicity claims arising from user-supplied content;
• Third-party service failures;
• Service interruptions; or
• Circumstances outside our reasonable control.

Nothing in this Privacy Policy excludes or limits liability that cannot legally be excluded or limited.

25. Indemnification

To the maximum extent permitted by applicable law, users and Merchants may be responsible for claims, losses, liabilities, damages, costs, and expenses arising from:

• Content they upload or submit;
• Lack of appropriate rights, licenses, permissions, or consents;
• Violation of applicable law;
• Violation of third-party intellectual-property rights;
• Violation of privacy or publicity rights;
• Misuse of the Services; or
• Breach of applicable AI Vastra agreements or policies.

Additional indemnification obligations may be contained in separate AI Vastra Terms of Service or commercial agreements.

26. Privacy Rights

Depending on applicable law, individuals may have rights including:

• Access to their Personal Data;
• Correction of inaccurate information;
• Deletion of Personal Data;
• Restriction of processing;
• Objection to certain processing;
